1. Agreement to these Terms

By accessing or using Witty Arcade, you agree to these Terms of Use and acknowledge the Privacy Policy. If you do not agree, do not use the site. Nothing in these Terms limits rights that cannot lawfully be excluded or waived in your jurisdiction.

2. What Witty Arcade provides

Witty Arcade provides game discovery pages, original editorial information, navigation tools, and browser-based access to games. Many games are supplied and hosted by independent third parties through iframe technology.

The site currently does not offer user accounts, paid subscriptions, payment processing, public comments, or a live contact form. Witty Arcade may add, change, suspend, or remove pages, games, or features when reasonably necessary.

3. Eligibility and supervision

You may use the site only if you can legally agree to these Terms under the law that applies to you. If you are a minor or otherwise cannot enter into this agreement on your own, a parent or legal guardian must review these Terms and supervise your use. Guardians are responsible for deciding whether a game is appropriate for the player.

4. Limited permission to use the site

Subject to these Terms, Witty Arcade gives you a limited, revocable, non-exclusive, non-transferable permission to access the site for personal, non-commercial entertainment. This permission does not transfer ownership of the site, its content, or any game.

5. Acceptable use

You must not:

• use the site for an unlawful, fraudulent, or abusive purpose;
• interfere with the site, overload it, introduce malicious code, or attempt unauthorized access to systems or data;
• bypass or defeat iframe sandboxing, content security rules, access controls, or other protective measures;
• use automated tools to scrape, copy, index, or extract content at a volume that disrupts the site or ignores stated technical controls;
• reproduce, republish, sell, frame, or commercially exploit Witty Arcade content without the required permission;
• misrepresent an affiliation with Witty Arcade or use the site to infringe another person's privacy or intellectual-property rights.

6. Third-party games and iframe content

An embedded game may be delivered from a domain operated by its developer, publisher, distributor, or host. Witty Arcade does not operate that external service and does not control all game content, data practices, availability, updates, advertisements, or in-game features. Displaying a game does not by itself mean Witty Arcade owns, sponsors, or endorses its provider.

The provider's own terms, privacy notice, and game rules may apply in addition to these Terms. If the provider's rules conflict with these Terms, its rules govern your relationship with that provider and that game only. Iframe sandbox restrictions reduce certain browser permissions but do not turn third-party content into content operated by Witty Arcade.

7. External links, accounts, and transactions

A game or external page may offer links, advertising, an account, multiplayer or chat features, virtual items, or a purchase. These are not Witty Arcade services. Witty Arcade does not currently process payments and is not a party to a transaction made with a game provider or another third party.

Review the third party's identity, terms, privacy practices, prices, refund rules, and safety information before interacting. Witty Arcade is not responsible for external accounts, purchases, communications, downloads, or disputes, except where applicable law requires otherwise.

8. Intellectual property

Witty Arcade's name, site design, selection and arrangement of content, original editorial text, and site code are owned by or licensed to their respective rights holders and are protected by applicable intellectual-property laws. Game names, artwork, logos, trademarks, software, and other game materials remain the property of their respective owners. No ownership right is transferred to you by using the site.

If you believe content accessible through Witty Arcade infringes your rights, do not send a notice through an embedded game because its provider is independent. Witty Arcade does not currently publish a public infringement-notice channel.

9. Availability and game progress

Games and pages may be changed, interrupted, blocked by a browser or network, become incompatible, or be removed without notice. Witty Arcade does not guarantee uninterrupted access or that a particular game will remain available.

Game settings or progress may be stored by your browser or by the game provider. Clearing browser storage, changing devices, provider updates, or removal of a game may erase that information. Witty Arcade does not currently provide an account-based backup or recovery service for game progress.

10. Disclaimers

To the maximum extent permitted by applicable law, Witty Arcade and its content are provided on an "as is" and "as available" basis. No warranty is made that the site or a game will be uninterrupted, error-free, secure, accurate, compatible with your device, suitable for a particular purpose, or free from harmful or objectionable third-party content.

Game descriptions and instructions are general editorial information, not professional, safety, medical, legal, or financial advice. You use the site and third-party games at your own discretion and risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, Witty Arcade and those involved in operating the site will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, game progress, opportunity, revenue, or profit arising from the site, an outage, a third-party game, an external link, or a third-party transaction.

Where liability cannot lawfully be excluded, it is limited to direct loss that was reasonably foreseeable and caused by a breach of these Terms. Nothing here excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability or consumer right that cannot legally be excluded.

12. Restriction of access

Witty Arcade may restrict or block access when reasonably necessary to protect the site or others, respond to legal requirements, investigate misuse, or enforce these Terms. The permission granted under these Terms ends automatically when you materially violate them.

13. Changes to these Terms

These Terms may be updated to reflect changes to the site, third-party relationships, security requirements, or applicable law. The revised version will be posted here with a new update date. Your continued use after an update means you accept the revised Terms to the extent permitted by law.

14. General terms

If any part of these Terms is found unenforceable, the remaining parts continue to apply. A failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, form the agreement concerning your use of Witty Arcade's own site.
